Medical Council of India (MCI) upholds the Delhi Medical Council order against the two doctors involved in the medical negligence case of late Dr. Anamika Ray.
Dr. Anamika Ray, an Asst. Professor at GU and a renowned media educator of the Northeast underwent laparoscopic gall bladder surgery in 2015 and embraced death due to the alleged medical negligence case filed by her husband against the doctors, which was later confirmed by the investigation undertaken by the Delhi medical council (DMC).
The entire case was later examined by the MCI at the appeal filed by Ankuran Dutta, husband of the victim, expressing dissatisfaction over the DMC order passed on June 16, 2017. "I was not satisfied with the DMC order, and therefore filed an appeal to enhance the punishment awarded to the two doctors. Though MCI after examining the entire case does not submit to my appeal but have made a judgment against the doctors considering that there was gross negligence on the part of the doctors", said Dr. Ankuran Dutta.
MCI through an order issued on July 27, 2019, upheld the DMC order to remove the two doctors involved in the medical negligence case from the state medical register of DMC for 15 days. "The ethical sub-committee of the Medical Council of India concluded that there is no infirmity in the order of the Delhi Medical Council and therefore, decided to uphold the order", stated the issued order.
"I am still not happy with the punishment awarded to the two doctors, later upheld by the MCI too as because it is unfortunate that doctors found guilty of someone's life still have the advantage to commit crimes through medical negligence and as a punishment get the 15-days holiday package under broad daylight", said Dutta.
The Delhi Medical council ruled out, "During the surgery, no ultrasound of the abdomen was done to confirm the diagnosis of acute cholecystitis, pre-anesthetic check-up, and preparation of the patient was not proper, there was no monitoring of airway pressure or ETCO2, operation theatre at the said hospital was not equipped to monitor end Tidal CO2, no cardiology consultation was sought immediately even though the patient suffered from a cardiac event, instead of admitting to the cardiac care unit (CCU) the patient was admitted in the surgical ICU and no autopsy was conducted".
"There is poor documentation of the clinical progress of the patient in the case records, the pre-operative assessment and findings are insufficient", MCI clarified.
Late Dr. Anamika Ray was undergoing treatment under Dr. Chandan Kr. Deka (DMC reg. no. 24331) and Dr. Abhijit Khaund (DMC reg. no. 15761) of Navjeevan hospital, New Delhi and later shifted to Jaipur Golden Hospital.
