Advocate Shantanu Borthakur, who was fighting the case for peasant leader Akhil Gogoi, said that the National Investigation Agency (NIA) has failed to produce any evidence of Gogoi’s involvement with Maoists as the former had alleged.
Shantanu Borthakur said, “Today, the court passed an order rejecting the prayer of the NIA seeking custody for another ten days of the accused Akhil Gogoi. The court, while passing the order, had perused the case diary and also heard the arguments of both the sides. The court’s prima facie finding is that the NIA has failed to produce substantial information regarding the involvement in these activities (Maoist), which may lead to his remand for another 10 days.”

However, the advocate stated that he was not aware of what the case diary had as it was between the court and the NIA.
It may be mentioned here that earlier, ADG (Law & Order) GP Singh had informed the media persons that they had received input of Akhil Gogoi and his associates’ involvement with the Maoists.
The ADG had said, “They were trying to spread Maoist functioning in the state of Assam and for this purpose, they had used various parts of the country. On the basis of that information, which was available, we had registered a case in Guwahati’s Chandmari.”
However, the NIA, which sought another 10-days custody of Akhil Gogoi, failed to produce any information on his involvement with Maoists and the court granted 14-days judicial custody. Gogoi will be lodged in the Guwahati Central Jail in Lalmati.

It may be mentioned here that the KMSS leader when he was taken out of the NIA court, smiled at the public and said, “People of Assam will do good.”
